An Austin man is suing the woman who was his date to see the new "Guardians of the Galaxy" movie after she texted throughout the film.

The man in question, 37-year-old Brandon Vezmar, recounted the awful date to Inside Edition, clearly still upset about the whole thing: "She was behaving as if this behavior was perfectly normal", he lamented.

Vezmar said in his petition the woman "activated her phone at least 10-20 times in 15 minutes to read and send text messages".

The woman at the center of the movie theater texting suit finally confronted her one-time date with the hope of putting the situation to bed.

The woman tells the newspaper Vezmar asked her later for the cost of the ticket, but she refused because "he took me out on a date". Days later, Cruz and Vezmar met for the first time since the date on national television, where she agreed to pay him is $17.31.

She says he exaggerated about how much she was texting during the movie.

In his court papers‚ he said the "texting was a direct violation of the theatre's policy and his date adversely affected Vezmar's viewing experience". The 37-year-old claimed that the woman had demonstrated one of his biggest pet peeves and hugely irritated him. She denied that it was constant texting.

She would also be filing a protective order against Vezmar‚ because he had contacted her sister also to ask for a refund. "His behavior made me extremely uncomfortable, and I felt I needed to remove myself from the situation for my own safety", she wrote. "I just went out on a date".

He filed the petition in Austin, Texas last week for $17.31, saying her behaviour was "a threat to civilised society".
