ZeniMax targets Samsung over Gear VR

The legal war between Bethesda owner ZeniMax and Oculus has stepped up yet another level.

After winning a $500 million judgement against Oculus over the development of the company's virtual reality technology, id Software parent Zenimax Media is now going after Oculus partner Samsung. Obviously the subpoenas gathered in something interesting in ZeniMax is willing to go to court again.

While the previous judgement against Oculus is likely to work in ZeniMax's favour, it's worth pointing out that the jury didn't find Oculus guilty of misappropriating trade secrets.

The lawyers for Zenimax are really working hard, as a new lawsuit has been announced. "To establish its VR business for its own commercial gain, Oculus breached the NDA, violated ZeniMax's intellectual property rights, and exploited ZeniMax's VR technology". It will be supported in court by the outcome of Zenimax's lawsuit against Oculus, as the Gear VR is based on the Oculus Rift. While at Oculus Carmack was one of the driving forces of the Gear VR, an Oculus-made headset for Samsung Galaxy phones. ZeniMax, who has published games in the Elder Scrolls, Fallout and Doom franchises, has filed a lawsuit against the South Korean-based company, claiming its Gear VR mobile headset uses code originally created at ZeniMax.

Carmack claims that after Zenimax initially agreed to purchase id Software for $150 million, it still owes $45.1 million. For those who may not know what that was about, ZeniMax alleged, among a couple of other things, that Oculus co-founder Palmer Luckey failed to comply with a non-disclosure agreement. An injunction filed in February against VR software that used certain contested lines of code includes both the Oculus Rift and Gear VR in its filing. Following the victory, ZeniMax chairman and CEO Robert Altman said the company would "consider what further steps we need to take to ensure there will be no ongoing use of our misappropriated technology".

Zenimax is seeking damages, a share in the profit from sales of devices that used stolen technology, injunctive relief, and royalties.
