The film, in which Hawn and Schumer play mother and daughter, was a big hit among people treating their mums to a Mother's Day movies, according to figures. But for one Texas man, it's worth going to court over.

The Austin American-Statesman reports that Brandon Vezma of Austin is suing the date he went with to a 3D showing of Guardians of the Galaxy Vol. 2 because she wouldn't stop texting during the movie.

"While damages sought are modest, the principle is important as defendant's behavior is a threat to civilized society", he claims in the petition.

Vezmar accuses his date of "adversely affecting the viewing experience" of moviegoers.

The couple met online and were on a first, and it appears last, date, the Statesman reported. But Vezmar's date proceeded to text throughout the movie.

According to the petition, the woman "activated her phone at least 10-20 times in 15 minutes to read and send text messages".

She said she was texting a friend, who was having a fight with her boyfriend. He stated that he suggested she exit the theater to text, and when she left, she never came back.

Vezmar contacted the woman after the doomed date asking to be repaid for the tickets, but she said she refused because "he took me on the date". His suit is filed against an unidentified 35-year-old woman who was allegedly texting during the film. To the news, she responded, "Oh my God". Then he said maybe she could go outside and text.

"I had my phone low and I wasn't bothering anybody", the woman said.

"I'm not a bad woman", she told the paper.

The epic film movie stood third at the box office, giving Marvel's Guardians of the Galaxy Vol 2 and Snatched first and second position respectively this weekend.
