Vijay Mallya freed on strict bail conditions in UK

After liquor baron Vijay Mallya, wanted in India for defaulting on bank loans of over Rs 8,000 crore, was arrested and granted bail in London on Tuesday, the Indian government said the legal process for his extradition is underway in Britain.

"We will definitely work to bring him back to the country".

Not only is he the liquor-baron king but he is also the "king of good times", that's stylish Vijay Mallya for you, a Kolkata boy who made it big in life. The court has set May 17 as the date for the next hearing.

In case of a warrant, the person is arrested and brought before the court for preliminary hearing followed by an extradition hearing before a final decision is taken by the Secretary of State.

The government is not going to leave any stone unturned to get Mallya extradited and face prosecution in Indian courts, said Sudesh Verma. The judge must decide whether any of the statutory bars in the Act apply in the case, including health and human rights grounds.

If that option also does not go in his favour then he can move the UK Supreme Court.

They are whether the person is at risk of the death penalty; whether specialty arrangements are in place; whether the person concerned has previously been extradited from another country to the United Kingdom and the consent of that country to his onward extradition is required; and whether the person has previously been transferred to the United Kingdom by the International Criminal Court.

CBI sources said Mallya's arrest had come specifically in connection with a case accusing him of defaulting on a Rs 900-crore loan from IDBI Bank.

According to the figures released by the Ministry of External Affairs on March 22, India has only successfully extradited 62 persons since 2002.

Mallya had fled India on March 2, 2016.

During his visit to London earlier this year, Finance Minister Arun Jaitley highlighted the seriousness with which India took the issue of defaulters, without direct reference to Mr. Mallya. His arrest triggers a long-drawn legal process, which will involve the UK's Crown Prosecution Service (CPS) arguing that Mallya must be extradited to India to stand trial on charges of fraud.
